    A Customer Demarcation will not be Up (i.e., it will be “Down”) when it is not providing such full functionality. A Customer Demarcation is “Up” when it is providing full end-to-end functionality, including access to the Internet at the Bandwidth Standard. Network Uptime is based upon the percentage that each Customer Demarcation, monitored in real time, is “Up” (as defined below) each calendar month.

    Network Uptime. Towerstream will maintain a Towerstream Network uptime (the “Network Uptime”) of at least 99.99% (“Network Uptime Standard”), calculated on a monthly basis, excluding downtime due to Force Majeure Events (up to a cap of twenty four (24) hours in the aggregate in a given month, except that the cap shall not apply to the extent the Force Majeure Event consists of acts of God, hurricanes or acts of nature causing widespread destruction) or scheduled maintenance during the Maintenance Window (“ Excluded Downtime”).
